The ENKORA website, online store and related services are operated by ENKORA GROUP LLC ("ENKORA," "we," "us," "our"), a company organized in the State of Washington, United States.
These Terms & Conditions ("Terms") govern your use of the ENKORA website and your purchase of products from ENKORA — whether online, by direct order, by quotation, as a project order or by any other agreed method of sale. By using the website or placing an order, you agree to these Terms and to the related ENKORA policies that apply to your purchase.
1. Related Policies
The following policies form part of the terms of your purchase:
- Shipping & Delivery Policy
- Returns, Refunds & Exchanges Policy
- ENKORA Limited Warranty
- Privacy Policy
- Cookie Policy
Where separate written terms have been agreed for a particular commercial, wholesale, project, custom or trade order, those terms control that order in the event of a direct conflict.
2. Eligibility
To make a purchase you must have legal capacity to enter into the transaction. If you order on behalf of a company or other organization, you confirm that you are authorized to act for it.
3. Accounts
If you use an account, you are responsible for keeping it confidential, for keeping your information accurate, and for activity under your account. ENKORA may restrict or suspend access if we suspect fraud, unauthorized use, a breach of these Terms or unlawful activity.
4. Quote Requests Submitted Through the Website
Many ENKORA products are priced on request. A quote request, project list or Trade Account application submitted through the website is a request for information — it is not an order and does not bind either party. A quotation from ENKORA sets out its own pricing, validity period, lead time and terms; an order is formed only when a quotation is accepted or an order is confirmed as described below.
5. Product Information
We work to provide accurate product information, including dimensions, voltage, wattage, lumen output, CCT, CRI, IP rating, cut length, maximum run, certifications, warranty and other specifications. Information may be updated to reflect product improvements, component or manufacturing changes, documentation updates or the correction of errors, and ENKORA may correct obvious errors at any time.
6. Photographs, Color and Appearance
Product images represent products as accurately as reasonably possible, but actual appearance may vary with display settings, lighting conditions, manufacturing tolerances, LED binning and permitted differences between production batches. Some photographs show a representative build of a product type. Where exact visual matching matters, we recommend ordering a sample or small quantity first.
7. LED Color, CCT and Binning
LED products may vary within permitted tolerances between production batches. When extending an existing installation, or where close matching of CCT, color tone or lighting characteristics is critical, we encourage you to buy the full quantity in a single order or to confirm batch compatibility with ENKORA in advance.
8. Technical Information
ENKORA may provide installation guides, specifications, wiring diagrams, product-selection advice, calculators, educational material and other technical information to help you select and use products. This information does not replace professional engineering or electrical design, the requirements of applicable electrical codes and the Authority Having Jurisdiction (AHJ), or a qualified evaluation of your project. The customer, designer and installer are responsible for confirming that a product suits the specific installation.
9. Installation and Electrical Work
Electrical products must be installed in accordance with ENKORA's instructions and published specifications, applicable electrical codes, AHJ requirements and other safety requirements. Where the law or the nature of the work requires it, installation must be performed by a qualified or licensed professional. ENKORA is not responsible for improper installation, wiring or system design by the customer or a third-party installer, except for liability that cannot be limited under applicable law.
10. Certifications
A certification or listing applies only to the products and configurations for which ENKORA expressly states it. Do not assume a product carries UL, ETL, cULus, FCC or any other certification unless it is stated on the product page, product label, datasheet or other official ENKORA documentation. The customer, designer or installer is responsible for determining whether a product meets the requirements of the project, jurisdiction or AHJ.
11. Orders
Placing an order is an offer to buy products on the stated terms. An automated confirmation that we received your order is not necessarily ENKORA's acceptance of it. Before final processing we may verify availability, payment authorization, shipping information, pricing and other reasonable matters, including suspected fraud.
ENKORA may cancel all or part of an order before shipment because of product unavailability, an obvious pricing or description error, a payment issue, suspected fraud, inability to fulfill the order or other reasonable circumstances. If we cancel a paid order before shipment, we refund the amount paid for the canceled items.
12. Pricing
Prices may change without notice for future orders. The price of an accepted order does not change because the website price later changes, unless separately agreed. If an obvious pricing error appears, ENKORA may correct it, offer you the chance to confirm the order at the correct price, or cancel the affected item and refund the amount paid.
13. Taxes
Unless stated otherwise, prices do not include applicable sales tax. ENKORA collects and remits taxes where required by law. To purchase tax-exempt or for resale, you must provide valid documentation before the exemption can be applied.
14. Payment
Orders are processed once payment is received or confirmed, unless ENKORA has granted separate written credit terms. ENKORA may use third-party payment processors. Approved commercial accounts may be subject to separate purchase-order, NET payment or credit terms.
15. Quotations and Project Orders
An ENKORA quotation may include project-specific pricing, a validity period, lead time, and shipping, payment, custom-product and special-order terms. Once a quotation is accepted, its terms apply to the resulting order. Changes to quantity, specifications, destination, schedule or scope may require a revised quotation.
16. Purchase Orders
Accepting a customer purchase order does not mean ENKORA accepts any additional or conflicting terms in it. Such terms apply only if accepted in writing by an authorized ENKORA representative.
17. Custom, Special-Order and Cut-to-Length Products
Custom-made, special-order, project-specific and cut-to-length products may carry separate cancellation terms, return restrictions, payment requirements and lead times. Once production, cutting, assembly or other custom processing has begun, the order may become non-cancellable and non-returnable in accordance with our Returns, Refunds & Exchanges Policy and the terms of the order.
18. Shipping
Order processing, same-day shipping, free shipping, oversized products, delivery estimates, shipping damage, shipping addresses and carrier delays are governed by our Shipping & Delivery Policy.
19. Returns, Refunds and Store Credit
Returns, refunds, exchanges and ENKORA Store Credit are governed by our Returns, Refunds & Exchanges Policy.
20. Warranty
Warranty coverage is governed by the ENKORA Limited Warranty. The warranty term for a product — a 3-Year or 5-Year Limited Warranty — is stated in its product documentation. These Terms do not reduce the written warranty that applies to a product.
21. Promotions and Discount Codes
Promotions and discount codes may expire, apply only to certain products, require a minimum purchase, exclude oversized, custom or project products, and may not be combined with other offers. Unless expressly stated otherwise, promotional offers have no cash value.
22. Intellectual Property
All content on the ENKORA website — including the ENKORA name, trademarks, service marks and logos, series names, graphics, photographs and product photography, videos, icons, page layouts, product descriptions, technical drawings, wiring diagrams, specifications, charts and tables, written content, downloadable materials, databases, software and other website elements — is owned by ENKORA GROUP LLC, its licensors or the respective rights holders, and is protected by U.S. and international copyright, trademark and other intellectual-property laws.
The ENKORA name, logos, series names, graphic elements and other brand identifiers may constitute trademarks, service marks or trade dress of ENKORA GROUP LLC. Nothing on the website grants any license or right to use ENKORA intellectual property except as expressly permitted by ENKORA in writing or by applicable law. Without ENKORA's prior authorization, website materials may not be copied, reproduced, published, distributed, modified, used to create derivative works, used commercially, or used in a way that suggests affiliation with, approval by or sponsorship by ENKORA.
Certain products, designs, technologies or components shown on the website may be protected by patents, design rights or other intellectual-property rights of ENKORA or other rights holders; their display does not grant any license. Third-party trademarks, product names, company names and logos belong to their respective owners, and their appearance does not imply affiliation, endorsement or sponsorship unless expressly stated.
23. Customer Content
If you provide project photographs, reviews, video or other content for possible publication or marketing use, ENKORA will use it in accordance with the permission you give and applicable law. You are responsible for having the rights and permissions needed to provide it.
24. Prohibited Use
You may not use the ENKORA website for unlawful purposes or fraud; to infringe intellectual-property rights; to distribute malicious software; to attempt unauthorized access to any system; to interfere with the website's operation; or for improper automated data collection.
25. Third-Party Services and Links
The website may link to or integrate with third-party services. ENKORA does not control independent third-party websites and is not responsible for their content, security, policies or practices. Your use of them is governed by their own terms and privacy policies.
26. Website Availability
We work to keep the website available and accurate but do not guarantee uninterrupted or error-free operation. The website may be unavailable at times because of maintenance, updates, technical issues, third-party providers or circumstances outside our reasonable control.
27. Limitation of Liability
To the maximum extent permitted by applicable law, ENKORA's total liability arising out of or relating to a product or order, on any legal theory — including contract, tort, negligence, warranty or indemnity — will not exceed the amount you actually paid ENKORA for the product or order that gave rise to the claim.
To the maximum extent permitted by applicable law, ENKORA is not liable for special, indirect, incidental, consequential, exemplary or punitive damages; loss of profits, revenue, business or opportunity; business interruption; project delays; loss of use of a product or property; or third-party claims against you — even if ENKORA was advised of the possibility of such damages.
Some states and jurisdictions do not allow the exclusion or limitation of certain damages or liability; in those cases these limitations apply only to the extent permitted by law. Nothing in these Terms limits ENKORA's obligations under the ENKORA Limited Warranty or any right that cannot be limited under applicable law.
28. Indemnification
To the extent permitted by law, a business or professional user agrees to indemnify ENKORA for reasonable losses, expenses and third-party claims arising directly from unlawful use of the website, breach of these Terms, misuse of the products or infringement of third-party rights, to the extent not attributable to ENKORA.
29. Force Majeure
ENKORA is not responsible for delay or failure to perform caused by circumstances beyond its reasonable control, including natural disasters, fire, flood, severe weather, war, civil disturbance, government action, transportation or carrier disruption, labor disruption, supplier disruption, widespread utility or infrastructure failure, or comparable events.
30. Governing Law and Venue
To the extent permitted by law, these Terms and related transactions are governed by the laws of the State of Washington, without regard to conflict-of-law principles. To the extent permitted by law, disputes may be heard in the courts having jurisdiction in Clark County, Washington, or in the appropriate federal court. This does not deprive a consumer of any right or forum that cannot be limited under applicable law.
31. Severability, No Waiver and Entire Agreement
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect to the maximum extent permitted by law. ENKORA's failure to enforce a right is not a waiver of that right. These Terms, together with the applicable ENKORA policies, quotation, order confirmation and any specifically agreed written terms, form the entire agreement between the parties for the applicable transaction.
32. Changes to These Terms
ENKORA may update these Terms for future use of the website and future orders. Changes do not apply retroactively to completed transactions where that is prohibited by law. The current version is posted here with its "Last updated" date.
